AZ AUTO DISMANTLER

Parts Warranty & Sales Terms

These Parts Warranty & Sales Terms ("Terms") apply to all parts sold by AZ AUTO DISMANTLER ("Seller") unless different terms are expressly stated in writing on the sales invoice or other written sales document.

By purchasing a part from AZ AUTO DISMANTLER, Buyer acknowledges that Buyer has read, understands, and agrees to these Terms.

1. Part Condition

All parts sold by AZ AUTO DISMANTLER are used, recycled, remanufactured, or otherwise previously installed parts unless expressly stated otherwise in writing.

Used and recycled parts may show signs of normal wear, damage, corrosion, discoloration, prior repair, or other evidence of previous use. Cosmetic condition, appearance, mileage, remaining service life, durability, and future performance are not guaranteed unless expressly stated in writing.

Buyer is responsible for inspecting the part before installation and determining whether the part is suitable for Buyer's intended use.

2. Fitment & Compatibility

Buyer is solely responsible for verifying that the part is correct for the intended vehicle and application before purchase and installation.

Buyer should verify compatibility using all applicable information, including:

  • VIN and vehicle identification information;
  • OEM or manufacturer part numbers;
  • engine and transmission configuration;
  • options and equipment;
  • connector and electrical configuration;
  • dimensions and physical characteristics; and
  • application and interchange information.

Year, make, and model alone do not guarantee compatibility.

Catalog information, interchange information, photographs, descriptions, and other application information are provided as aids to identification and are not, by themselves, a guarantee that a part will fit or perform properly in a particular vehicle.

Buyer is responsible for confirming fitment before accepting and installing the part.

3. Returns & Refunds

All returns require prior approval from AZ AUTO DISMANTLER and the original sales invoice.

A purchase is not automatically returnable because Buyer changes their mind, orders the wrong part, determines that the part is unsuitable, or otherwise no longer wants the part.

Unless otherwise stated in writing at the time of sale, returns must be requested within the applicable return period established by Seller and, except where otherwise required by applicable law, no refund will be issued after the applicable return period has expired.

Approved returns are subject to inspection and must be returned in the same original, complete, and unaltered condition in which they were sold. Seller may charge a restocking fee of up to 30% of the purchase price or $250, whichever amount is applicable under the sales transaction.

Refunds will be issued to the original form of payment or, where applicable, by company check.

Refunds for payments originally made by check will be processed within 10 working days of the applicable invoice date. Other refunds may be issued by company check.

Nothing in these Terms is intended to limit any rights that cannot legally be waived under applicable law.

4. Non-Returnable Items

Except where otherwise required by applicable law, the following items are non-returnable:

  • electrical and electronic parts;
  • special-order parts;
  • altered or modified parts;
  • disassembled parts;
  • overheated or damaged parts after purchase;
  • body cuts;
  • airbags and related safety restraint components; and
  • other items specifically identified as non-returnable on the invoice or at the time of sale.

These items are sold on an as-is basis unless a separate written warranty is expressly provided at the time of sale.

5. Limited Warranty

Unless otherwise stated in writing at the time of sale, qualifying mechanical parts are covered by a limited 30-day warranty beginning on the date of purchase.

The warranty applies only to the part identified on the original invoice and only to the original purchaser. The warranty is non-transferable.

If Seller determines, after inspection or testing, that a warranted part is defective during the applicable warranty period, AZ AUTO DISMANTLER may, at its option:

  1. replace the part with another part of comparable type and condition, if available; or
  2. refund the purchase price of the defective part.

Seller's obligation under the warranty is limited to the original purchase price of the warranted part.

The warranty does not cover labor, installation, removal, diagnosis, towing, transportation, rental vehicles, shipping or freight charges, loss of use, or any other incidental or consequential expenses.

If a replacement part is provided, the replacement is subject to Seller's applicable warranty terms unless otherwise stated in writing.

6. Warranty Claim Procedure

Buyer must contact AZ AUTO DISMANTLER before returning, repairing, modifying, disassembling, or replacing a warranted part because of an alleged failure.

To process a warranty claim, Seller may require:

  • the original sales invoice;
  • vehicle identification information;
  • a description of the alleged failure;
  • diagnostic information;
  • proof of proper installation;
  • documentation from the installing repair facility; and
  • an opportunity to inspect or test the part.

Seller may require the vehicle or part to be made available for inspection or testing before determining whether a warranty remedy applies.

Buyer should not disassemble a warranted engine, transmission, differential, or other mechanical assembly before contacting Seller. Disassembly may void the applicable warranty.

7. Conditions That Void the Warranty

The limited warranty does not apply to parts that have been:

  • improperly installed;
  • installed without following applicable manufacturer or industry procedures;
  • modified or altered;
  • disassembled without Seller's authorization;
  • overheated;
  • damaged after purchase;
  • operated without required fluids, lubricants, filters, cooling systems, or other supporting components;
  • installed without correcting an underlying condition that caused or contributed to the original failure; or
  • otherwise used or installed in a manner inconsistent with the part's intended application.

The warranty may also be void if Buyer fails to use required supporting components or fails to follow applicable installation or preparation procedures.

Proof of proper professional installation may be required when reasonably necessary to evaluate a warranty claim.

Handwritten receipts, unsupported statements, or unsupported diagnostic claims may not be sufficient to establish a warranty claim.

8. Installation Requirements

Buyer is responsible for ensuring that all parts are properly installed and prepared for use.

Installation should be performed by a qualified professional or in accordance with applicable manufacturer procedures and accepted industry practices.

Buyer is responsible for replacing or servicing any required supporting components, fluids, filters, seals, gaskets, belts, hoses, sensors, or other components necessary for proper operation.

Failure to properly install or prepare a part may void any applicable warranty.

9. As-Is / Non-Warranty Parts

Parts sold without a stated warranty are sold AS-IS, WHERE-IS, WITH ALL FAULTS, except as otherwise expressly stated in writing or required by applicable law.

To the extent permitted by applicable law, Seller makes no warranties, express or implied, regarding non-warranty parts, including warranties of merchantability or fitness for a particular purpose.

Buyer acknowledges that, except for representations expressly stated in writing by Seller, Buyer is purchasing the part based on Buyer's own inspection and determination that the part is suitable for Buyer's intended use.

10. Written Representations

Buyer acknowledges that Buyer is not relying on any oral or verbal representation concerning the condition, compatibility, mileage, operation, suitability, or expected service life of a part unless that representation is expressly confirmed in writing by AZ AUTO DISMANTLER.

Any written representation made by Seller that is intended to modify or supplement these Terms must be documented on the sales invoice or another written document issued by Seller.

11. Buyer Responsibility

Buyer is responsible for:

  • verifying part compatibility before purchase;
  • inspecting the part before installation;
  • ensuring proper installation and preparation;
  • following applicable installation procedures;
  • using all required supporting components; and
  • determining whether the part is suitable for Buyer's intended use.

Buyer acknowledges that used and recycled parts may have ordinary signs of wear and that Seller does not guarantee the remaining service life or future performance of a part unless expressly stated in writing.

12. Limitation of Liability

To the fullest extent permitted by applicable law, AZ AUTO DISMANTLER's responsibility for a defective or improperly functioning part is limited to the remedies expressly provided under the applicable written warranty, if any.

Seller is not responsible for labor costs, installation or removal costs, diagnostic charges, shipping or freight charges, towing fees, rental expenses, loss of use, lost income, lost profits, or other incidental or consequential damages arising from the purchase, installation, failure, or use of a part, except to the extent such limitation is prohibited by applicable law.

13. No Consequential Damage

To the fullest extent permitted by applicable law, AZ AUTO DISMANTLER is not responsible for damage allegedly caused by the failure or use of a purchased part, including damage to an engine, transmission, vehicle, property, or other components, unless such liability cannot legally be excluded or limited.

14. Order Errors

Buyer is responsible for confirming that the correct part has been ordered before completing the purchase.

Parts incorrectly ordered by Buyer may require return approval and may be subject to applicable restocking fees and shipping charges.

AZ AUTO DISMANTLER is not responsible for errors made by Buyer when selecting, ordering, or identifying a part.

15. Core Returns

Where a core deposit is required, the core must be returned within 10 working days of purchase unless a different period is stated in writing.

The returned core must be the same type of component as the part purchased and must be returned complete and in reasonably acceptable condition for core credit.

Incomplete, damaged, altered, disassembled, or otherwise unacceptable cores may receive reduced or no core credit.

All cores must be fully drained of fluids before being returned. A $50.00 fluid disposal fee may be charged for any core returned with fluids present.

Once a core is returned to AZ AUTO DISMANTLER and accepted by Seller, it becomes the property of AZ AUTO DISMANTLER. Returned cores may be processed, dismantled, rebuilt, recycled, or disposed of and will not be returned to Buyer.

16. Shipping & Deposits

Shipping charges and deposits are non-refundable except where otherwise required by applicable law or expressly agreed to in writing by Seller.

Buyer is responsible for providing accurate shipping information and for any additional costs resulting from incorrect or incomplete information supplied by Buyer.

17. Loading & Transportation

Buyer is responsible for providing an appropriate vehicle and for properly securing all purchased parts for transportation.

Any loading assistance provided by AZ AUTO DISMANTLER personnel is provided at Buyer's risk.

To the fullest extent permitted by applicable law, AZ AUTO DISMANTLER is not responsible for damage to Buyer's vehicle, property, or purchased parts occurring during loading or transportation after the part has been released to Buyer.

Seller may refuse or limit loading assistance if Seller determines that the vehicle, equipment, personnel, or loading conditions are unsafe or inadequate.

Buyer is responsible for determining whether Buyer's vehicle and equipment are suitable for transporting the purchased parts.

18. Pickup & Storage

Purchased parts must be picked up within a reasonable period following purchase or within any pickup period stated on the invoice.

AZ AUTO DISMANTLER may charge reasonable storage fees for parts that are not picked up promptly after notice to Buyer.

After providing any notice required by applicable law, Seller may dispose of or otherwise handle unclaimed parts that remain at the facility for an unreasonable period.

19. Transfer of Ownership & Risk of Loss

Ownership of a purchased part transfers to Buyer upon completion of the sale and release of the part from AZ AUTO DISMANTLER's facility, unless otherwise agreed in writing.

Risk of loss or damage transfers to Buyer when the part is released to Buyer or Buyer's carrier.

20. California Proposition 65

WARNING: Vehicles and vehicle parts may expose you to chemicals known to the State of California to cause cancer and reproductive harm.

21. Entire Agreement

These Terms, together with the applicable sales invoice and any written warranty or written representation expressly provided by AZ AUTO DISMANTLER, constitute the agreement between Buyer and Seller concerning the sale of the part.

No verbal statement or representation is intended to modify these Terms unless confirmed in writing by an authorized representative of AZ AUTO DISMANTLER.

If any provision of these Terms is determined to be unenforceable under applicable law, the remaining provisions will remain in effect to the extent permitted by law.

22. Buyer Acknowledgment

By purchasing a part from AZ AUTO DISMANTLER, Buyer acknowledges and agrees that:

  • Buyer has read and understands these Terms;
  • Buyer understands that the parts are used, recycled, remanufactured, or previously installed unless otherwise stated;
  • Buyer has had the opportunity to inspect the part before installation;

  • Buyer understands that labor, installation, towing, shipping, rental, and consequential expenses are not covered by the limited warranty; and
